Terms & Conditions For Event Hire

Any quotation, credit application, delivery docket or any hire schedule form part of these terms, whether signed by You or not (together with the terms, the Agreement). In return for us agreeing to consider your order you agree that these conditions apply if we do not accept your order or if we do not supply you with Goods. We are not obliged to accept any orders from you, but if you do place an order with us then it becomes binding from the moment that we accept it even if we do not tell you that it has been accepted.  Any quotation is merely an invitation to you to place an order with us.  If you offer to hire goods based on a quotation from us, then your offer is subject to these conditions. You should read and consider these terms and conditions carefully. For the purposes of this Agreement, ‘Goods’ shall mean any and all marquee letters, festoon lighting, mesh frames, shimmer walls and balloon garlands available for hire from Lit Letters.

1. HIRE PERIOD AND KEY HIRE TERMS

  • The period of hire of the Goods shall commence on the earlier of the date on which you take possession or on delivery of the Goods to the address nominated by you.  
  • We agree to hire You the Goods on an exclusive basis in good working order, free from defects. 
  • Lit Letters will not be held liable should the light up letters or festoon lighting trip/malfunction during the Hirer’s event due to inclement weather and rain. Lit Letters’ Goods are weather-resistant but are not specifically waterproof, and although rare, like any other electrical appliance they may malfunction when exposed to water.
  • If the event is outside, it must be notified at time of hire.
  • If there are stairs, it must be notified at the time of hire.
  • The following venues will have additional fees – Crown Resort, Sitella Winery, Hillary’s Boat Harbour, Duxton Hotel, Pan Pacific Hotel.

2. HIRE FEES

  • Hirer must pay the hire fees specified in Lit Letters’ quote for the duration of the Hire Period and in accordance with this Agreement.
  • Unless otherwise agreed, the Hire Fees are due 1 weeks prior to the event/hire date. 
  • The Hire Fees shall include all delivery, collection and set up of the Goods.
  • If you cancel within 7 days of your booking being placed, Lit Letters will charge a fee of 50% (of the total quoted hire cost), and the other 50% will be refunded. If the cancellation is made within 48 hours of the event/hire date, there will be no refund. 
  • A minimum 4 hour window is required for delivery and collection. Less than 4 hours will have an additional fee of $25. Less than 2 hours will have an additional fee of $50 for both delivery and collection.
  • Same night collection will have a fee of $50 for 1-3 letters. $75 for 4-6 letters. $100 for 7 letters or more.
  • COVID cancellations – We’re happy to reschedule if the booking is affected by a lockdown providing we have not yet delivered the goods, otherwise normal cancellation fees will apply.

3. DELIVERY AND RETURN

  • Lit Letters will endeavour to effect delivery and collection of the Goods at the times indicated by hirer but will not under any circumstances be liable for any delay in delivery or collection or for failure to deliver or collect. 
  • Delivery radius – northern suburbs and 35km east and south of CBD. Additional fees will apply for deliveries outside those zones.

4. YOUR OBLIGATIONS TO US

  • Hirer Must
    • keep the Goods in proper working order and condition
    • not alter, tamper, damage, move or repair the Goods without our written consent
    • not remove any label, identifying mark or safety instruction from the Goods;
  • If the goods are damaged and capable of repair, Hirer must compensate Lit Letters for the cost of repair. If the Goods are lost or damaged beyond repair, Hirer must pay Lit Letters the new replacement cost of the Goods and any other costs incurred by Lit Letters due to loss or damage of the Goods.
  • In the event that the Goods are damaged in circumstances where a claim can be made upon insurance effected by Lit Letters pursuant to these Terms then the Hirer must;
    • Report the damage to Lit Letters immediately upon the Hirer becoming aware of such damage;
    • Provide all necessary co-operation to Lit Letters and the insurer in respect of any claim;

5. TERMINATION 

  • Without affecting any other rights Lit Letters may have, Lit Letters may terminate these Terms at any time without liability to Hirer if Hirer breaches these terms or fails to pay any amount when due.
